General Information on Hong Kong Certificate of Identity


Endorsement on Hong Kong Certificate of Identity

To ensure that Hong Kong Certificates of Identity will be acceptable for the purpose of international travel and for return to Hong Kong Special Administrative Region (SAR) after 30 June 1997, the British and Chinese Government have agreed that the Hong Kong Certificate of Identity will contain the following statement(s) :


"The holder of this Certificate of Identity has Hong Kong permanent identity card number (XYZ) which states that the holder has the right of abode in Hong Kong."

"The child ____________ included in this Certificate of Identity has Hong Kong permanent identity card number (XYZ) which states that he/she has the right of abode in Hong Kong."

Except those who already have Hong Kong permanent identity cards, all Hong Kong Certificate of Identity applicants, including children (irrespective of age) to be included in the Certificates, will have to obtain Hong Kong permanent identity cards at the same time when they apply for Hong Kong Certificates of Identity. This will enable the entry of the statement(s) onto the Certificate of Identity.

Table 2 : Child born on or after 1 January 1983

(a) If child was born or adopted in Hong Kong - child's birth certificate or adoption certificate with Hong Kong belonger status or Hong Kong permanent resident status under paragraph 2(a) of the First Schedule to the Immigration Ordinance (Cap. 115) as "established".
(b) If child was born outside Hong Kong - child's birth certificate showing parents' names, plus : if mother was born in Hong Kong, her birth certificate; if father was born in Hong Kong, his birth certificate and marriage certificate.
(c) If child is a British Dependent Territories citizen by registration - child's registration certificate.
In special circumstances, you may be required to produce additional documents (original and photostat copies) to establish the nationality and identity of the child; this will always be the case if the birth certificate does not show the name of the child, or if the birth certificate shows Hong Kong belonger status or Hong Kong permanent resident status under paragraph 2(a) of the First Schedule to the Immigration Ordinance (Cap. 115) as "not established".

1. 純粹為華人血統或帶有華人血統並曾在任何時間至少連續7年通常居於香港的人。
2. 英國屬土公民且 ─
(a) 屬《1986年香港(英國國籍)令》** (1986年第233號法律公告)第2條所指明與香港有關連的界別或種類的人；或 (** “《1986年香港(英國國籍)令》”乃“Hong Kong (British Nationality) Order 1986”之譯名。)
(b) 憑藉與《1981年英國國籍法》++ (1981 c.61 U.K.)附表6所述的英國屬土(香港以外)的關連而成為英國屬土公民並曾與(a)分節所指明的人結婚的人。 (++“《1981年英國國籍法》”乃“British Nationality Act 1981”之譯名。)
*3. 屬英聯邦公民並在緊接1983年1月1日之前憑藉當時有效的第8(1)(a)條享有香港入境權的人。　 (* 註︰為方便查閱，現將已廢除的第8(1)(a)條重錄於附錄內。)

“8. 香港入境權及在無逗留條件規限下留在香港的權利
(1) 下述各人享有香港入境權 ─

( * “香港本土人”(Hong Kong belonger) 在第2(1)條(釋義)中界定如下─
““香港本土人”(Hong Kong belonger) 指─
(a) 緊接1983年1月1日之前─
(i) 在香港出生的英籍人士；
(ii) 憑在香港入籍而成為英籍人士的人；
(iii) 根據《1948年英國國籍法》第7(2)條在香港登記而成為英籍人士的人；
(iv) 與上述(i)、(ii)或(iii)節所述的人結婚或曾與其結婚的英籍人士，或屬上述(i)、(ii)或(iii)節所述的人的子女的英籍人士；”。

5(1)Subject to paragraph 6, the requirements for naturalisation as a British Dependent Territories citizen under section 18(1) are, in the case of any person who applies for it—
(a)the requirements specified in sub-paragraph (2) of this paragraph, or the alternative requirement specified in sub-paragraph (3) of this paragraph ; and
(b)that he is of good character; and
(c)that he has a sufficient knowledge of the English language or any other language recognised for official purposes in the relevant territory; and
(d)that either—
(i)his intentions are such that, in the event of a certificate of naturalisation as a British Dependent Territories citizen being granted to him, his home or (if he has more than one) his principal home will be in the relevant territory ; or
(ii)he intends, in the event of such a certificate being granted to him, to enter into, or continue in, Crown service under the government of that territory, or service under an international organisation of which that territory or the government of that territory is a member, or service in the employment of a company or association established in that territory.
(2)The requirements referred to in sub-paragraph (1)(a) of this paragraph are—
(a)that he was in the relevant territory at the beginning of the period of five years ending with the date of the application, and that the number of days on which he was absent from that territory in that period does not exceed 450 ; and
(b)that the number of days on which he was absent from that territory in the period of twelve months so ending does not exceed 90; and
(c)that he was not at any time in the period of twelve months so ending subject under the immigration laws to any restriction on the period for which he might remain in that territory; and
(d)that he was not at any time in the period of five years so ending in that territory in breach of the immigration laws.
(3)The alternative requirement referred to in sub-paragraph (1)(a) of this paragraph is that on the date of the application he is serving outside the relevant territory in Crown service under the government of that territory.
