



政府豁免主要適用於法定要求,而非普通法下的侵權責任。若政府部門(如食環署)在火災事故中被證明違反謹慎責任,豁免並不能完全免除其責任。例如,若骨灰龕未有安裝足夠的消防設施,且此疏忽直接導致火災損害,政府可能被判承擔疏忽責任。
Statutory standards may have a bearing on the determination of the standard of care in a negligence action. If there is legislation stipulating a particular standard of care ( eg a regulation requiring employers to supply safety goggles to a welder), the provision may be used as strong evidence of the standard of care in the negligence action. In effect, a breach of the statutory provision may be taken to be prima facie evidence of breach of duty in the negligence action. For instance, in Tang Shau Tsan v Wealthy Construction Co Ltd (unrep., HCPI 1092/1998, [1999] HKLRD (Yrbk) 374), the finding of negligence was reached solely on the basis of the defendant/employer's breach of statutory duty to place a guard on a circular saw.
