嘉義縣一名男子阿宏（化名），今年3月間在老人會館旁停車場，看見一名女子在車輛後座
旁，彎腰整理物品，竟色慾薰心，將她推入後座並壓制，企圖性侵。女子奮力反抗並尖叫求
救，過程中更咬傷洪男手指，最終趁隙逃出車外。嘉義地院審理後認定洪男涉犯強制性交未
遂罪，依刑法判處有期徒刑4年2月。
判決書指出，阿宏當時突然出手，將女子上半身推進車內並用身體壓住，下體多次頂住女子
臀部，並拉扯衣物、舔舐其耳朵，左手試圖觸摸胸部，還恐嚇「妳給我惦惦（臺語）」、「
妳給我爬上去」、「妳給我安靜下來」、「不然我讓你死喔」等語，要求她進入車內。
女子一邊大聲呼救，一邊用雙腿抵住車門、防止被完全推進，並咬住阿宏手指，才得以脫身
。
事發地點位於市區停車場，監視器與行車紀錄器清楚拍下阿宏靠近、女子尖叫、裙子被掀至
腰部等畫面；鑑識也在女子臉頰檢出與阿宏相符的DNA。阿宏否認有性侵意圖，聲稱只是想
解釋誤會，但法院認為他的行為與言語均顯示具有性交犯意，且在女子強烈反抗下仍持續施
暴，屬性侵未遂。
法官審酌，阿宏與被害人素不相識，卻於光天化日、公眾場所公然侵犯性自主權，造成嚴重
心理創傷，犯後否認犯行、毫無悔意，且有多項前科，素行不佳，應予嚴懲。全案可上訴。

A man in Chiayi County has been convicted of attempted sexual assault after attempting to assault a woman in a public parking lot in broad daylight. The incident occurred in March when the man, identified only by the alias Ah Hong, approached a woman who was bent over organising items beside her car near an elderly centre. According to court findings, he suddenly pushed her into the back seat of her vehicle, pressing down on her and attempting to commit a sexual offence.
The woman resisted fiercely, shouting for help, and managed to bite Ah Hong’s finger during the struggle, which enabled her to escape. Surveillance footage from nearby cameras captured Ah Hong approaching the woman, who was screaming and with her skirt lifted to her waist. Forensic analysis also found DNA matching Ah Hong on her face.
The court heard that Ah Hong’s actions included pushing the woman into the vehicle, pressing his body against her, repeatedly pressing his lower body against her hips, pulling at her clothes, licking her ear, and attempting to touch her chest. He also issued threats such as “You give me a chance,” “Get on top,” “Be quiet,” and “Otherwise I’ll kill you,” urging her to get into the car.
Despite her protests and physical resistance, Ah Hong continued his assault. The woman fought back with her legs against the car door and ultimately escaped, sustaining injuries from biting Ah Hong’s finger.
Ah Hong denied any intent to commit sexual assault, claiming he was trying to clarify a misunderstanding. However, the court found that his behaviour and words demonstrated clear sexual intent, and that his continued assault despite her resistance constituted attempted sexual assault.
The judge noted that Ah Hong and the victim did not know each other and that he had publicly and unlawfully infringed on her sexual autonomy in a busy public area, causing significant psychological trauma. His denial and lack of remorse, along with previous convictions and poor conduct, warranted a stern punishment. The court sentenced him to four years and two months in prison, with the case being eligible for appeal.
