Taiwanese University Student Sentenced for Sexual Assault During Drunken Night
In a disturbing case in Taiwan, a university student was sexually assaulted by his younger peer after a night of heavy drinking. The incident sparked outrage and led to a court ruling that sentenced Xiaoshuai to 3 years and 2 months in prison, despite his initial denial of the charges.
Last year, university student Dazhuang (pseudonym) was invited to the Taoyuan residence of his younger schoolmate Xiaoshuai (pseudonym) to drink. The two engaged in a lively night of drinking, continuing into the early morning hours. Dazhuang, overcome by the alcohol, passed out. To Dazhuang's horror, Xiaoshuai then took advantage of the situation, removing Dazhuang's pants and performing oral sex on him, as well as sexually assaulting him with his fingers.
When Dazhuang regained consciousness the next day, he was shocked to discover he had been violated. Outraged, he filed a complaint and took the case to court, adamantly refusing to forgive his assailant and requesting a harsh sentence.
The court ruling stated that on the night of April 15, 2023, Dazhuang and Xiaoshuai had gathered at Xiaoshuai's residence in Zhongli, Taoyuan to drink. As the night wore on, the heavily intoxicated Dazhuang passed out. Xiaoshuai then took the opportunity to remove Dazhuang's pants, grope him, perform oral sex, and sexually assault him with his fingers.
The next day, a sober Dazhuang realized he had been violated and reported the incident to his family, filing a complaint with the police accompanied by his sister. During the investigation and interrogation, Xiaoshuai initially denied the charges, only admitting to the crime during the court proceedings. However, Dazhuang remained unwilling to forgive him, and Xiaoshuai was therefore unable to receive a reduced sentence.
The judge considered that while Xiaoshuai had no prior criminal record and was a mentally sound adult, he had taken advantage of Dazhuang's intoxicated state and violated his right to sexual autonomy. Given Dazhuang's unwillingness to reconcile and his request for a harsh punishment, the court sentenced Xiaoshuai to 3 years and 2 months in prison for the crime of sexual assault. The case remains open to appeal.
