23條立法 英國內政部今日起進一步放寬BN(O)簽證申請資格!

喺香港政權就基本法第23條立法舉行一個月嘅極短諮詢同時，英國內政部喺2024年1月31日修改移民法則 immigration rules。進一步放寬申請資格，移除未婚伴侶需要同居兩年嘅要求。我哋歡迎內政部嘅修改，相關放寬將進一步保護身處全球嘅香港英國國民同佢哋嘅家眷。

以下係相關指引更新日誌嘅英文原文：

Updated to reflect changes to the relationship requirement to remove the need for partners to have been living together for at least 2 years prior to applying.

以伴侶身份申請BN(O)簽證，而家只需要證明以下其中一項就會滿足簽證申請關係嘅要求：
- 英國認可民事伴侶關係或婚姻關係
- 伴侶關係，並且共同生活至少 2 年
- 至少 2 年伴侶關係， 但無法同住，例如因為喺唔同地方工作或學習，或者係因為文化習俗而不被接受。

如果申請人同BN(O) citizen唔係一齊住，就需要證明對彼此有持續承諾，例如提供證據證明：
- 定期互相溝通
- 在經濟上互相支持
- 共同撫養小朋友
- 共度時光，例如度假或參加活動

另外，有關等候庇護期間改為申請BN(O)簽證嘅安排，UK Visas and immigration 已經開始通知受影響嘅申請者。大部分申請人亦都應該會收到通知內政部撤銷簽證申請不成功嘅決定。如果你喺未來四個星期仍未收到任何通知，請致電UKVI：0300 790 6268 或者透過Hong Kong Aid 港援向相關部門查詢。

有唔少英國官方文件都會用BNO Citizen稱呼透過Visa居留嘅BNO holder

但英國無反駁隊

根本九七前香港人根本唔需要申請乜乜柒柒自動可以有，鐘意幾時黎都得！

都唔係既 總有班人97前出世既父母唔知點解係無申請BNO 或者你條囝/囡真係97後出世

其實都唔算輕微， 一直有唔少申請都因為同住要求卡關
不過當然， 我哋會繼續努力爭取有利身處香港受迫害港人嘅政策， 爭取喺權衡安全風險下嘅放寬政策

咩事

話說當年有唔少 case 係用信代替左同居要求，後來又改嚴返唔得，不過依家明文容許：

BNO Visa Guidance 就寫：The relationship between the Household Member and the Household Member partner must be genuine and subsisting. The Household Member partner should normally live with the BN(O) Household Member and intend to live with the BN(O) Household Member once in the UK.” 同時又寫，如果未結婚就必須要證明到“They have been living together in a relationship similar to marriage or civil partnership for 2 years before applying”

但我地再沿著呢段再睇下面專登 reference 既 Family Policy Guidance 其中有關 partner 既 2 years living together requirement一節就講到：“However, the 2-year period does not have to have been completed immediately preceding the date of application if, for example, the couple are currently living apart for work reasons in order to meet the financial requirements of the rules, provided that the relationship continues to be genuine and subsisting at the date of application.”
