Immigration Rules Appendix Hong Kong British National (Overseas)

The Hong Kong British National (Overseas) route has two routes – the BN(O) Status Holder route and the BN(O) Household Member route.

重點：
1）分兩階段，第一階段於2021年1月31日起申請，要到指定中心(VAC)，位於北角，須於申請獲批後90日内抵達英國本土。第二階段於2021年2月23日起申請，可以透過「英國移民：身份檢查（UK Immigration: ID Check）」手機應用程式，掃描其護照、臉部，以及讀取附生物認證護照中的晶片辦理手續。
2）可以在英國境內申請
3 ) 沒有簽證數量限額
4）簽證期：30個月簽證，之後再續30個月，或一次性5年期簽證
5 ) 一次性5年期簽證收費每人£250，可續期30個月簽証收費每人£180
6）可以工作或讀書，但不可以申請 Public Fund ( social welfare benefits )
7）居住滿5年後，可以申請 indefinite leave to remain（ILR），12個月後可以申請 British citizenship（BC）

申請條件：
1）持有 BNO 國籍 （毋須持有有效 BNO 護照，有效的 BNO 護照能加快審批程序，BNO 護照已過期或遺失都可以）
2）通常居住在香港
3）有居住/財政證明至少夠在英國生活6個月
4）承諾會學習英文
5）持有認可肺結核健康證明（可在香港或英國檢查）

6）支付 Immigration Health Surcharge ( IHS ) 費用
成人費用：
30個月簽證：£1,560
5年期簽證：£3,120

18歲以下未成年子女費用：
30個月簽證：£1,175
5年期簽證：£2,350

若 BNO VISA 申請人，即持有 BNO 國籍者， 可以帶同以下家屬同時入境英國：
1）配偶
2）未婚伴侶
3）18歲以下子女（首次申請時未滿18歲）
4）BNO 國籍持有人的1997年7月1日或以後出生的成年人子女，以及該成人子女的配偶及18歲以下未成年子女
5）其他家庭成員, 要證明高度依賴 BNO VISA 申請人

居留權與國籍 Settlement and citizenship

居住滿5年後，可以申請 indefinite leave to remain（ILR），如果持有其他英國簽證並於英國居留，例如 general work ( Tier 2 ) 簽證，已居留年期可以計算入 BNO VISA 居住期5年內。

符合以下所有條件，並居住滿5年，方可申請 indefinite leave to remain（ILR）：

1 ) 符合英語能力要求，只有65歲以上，以及證明大學主要用英語教方可豁免。英國以外大學學位可於 UK NARIC 確認其學位學歷同英文程度符合英語能力要求
2 ) 在 life in the uk test 合格
3 ) BNO VISA 居住期5年內連續12個月沒有離開英國本土多於180日
4 ) 支付申請 indefinite leave to remain（ILR）費用

獲得 indefinite leave to remain（ILR）後，再居住滿12個月後可以申請 British citizenship（BC），並支付申請 British citizenship（BC）費用。

The Hong Kong BN(O) Visa will be open for applications from 31 January 2021.

There will be no quota on numbers.

A five-year visa will cost £250 per person. Applicants will also be able to apply for a 30-month visa which will cost £180 per person.




由於 BNO VISA 於2021年1月起接受申請，BNO 國籍持有人及其家屬，現可以在入境英國時申請 Leave Outside the Rules（LOTR）許可，維期六個月（SIX MONTHS）。

Leave Outside the Rules（LOTR）申請人注意：

不可以獲取公共福利，亦不能免費享用英國國民保健署（NHS）的醫療服務。內政部亦在7月28日更新指引，要求 LOTR 持有人及其家屬必須擁有全面醫療保險（full health insurance），直到 BNO VISA 生效及支付 Immigration Health Surcharge ( IHS ) 費用後。

申請 LOTR 人仕毋須持有有效 BNO 護照，需照持有 BNO 國籍。英國邊境人員可以翻查紀錄確認申請人的 BNO 國籍，但英國內政部亦指出，若能出示有效的 BNO 護照能加快審批程序。邊境人員亦有權不批准 LOTR 許可申請。

申請 LOTR 人仕亦須要提供有效證據證明持有 BNO 國籍人仕及其家屬（配偶、同居兩年以上的同性或異性伴侶、子女等）的關係。

英國內政部亦在8月3日更新，建議申請人應以家庭為單位，全家移居（advise families to travel to the UK together）。

英國內政部亦在9月22日更新，BNO 國籍持有人的1997年7月1日或以後出生的成年人子女，以及該成人子女的配偶及18歲以下未成年子女。

太空人注意事項

HK 15.4. Each of the applicant’s parents must either be applying at the same time as the applicant, or have permission to be in the UK (other than as a visitor), unless:
(a) the parent with permission as a BN(O) Status Holder or as a partner of a BN(O) Status Holder is the sole surviving parent; or
(b) the parent with permission as a BN(O) Status Holder or as a partner of a BN(O) Status Holder has sole responsibility for the child’s upbringing; or
(c) there are serious and compelling reasons to grant the child entry clearance or permission to stay with the parent who has permission on the Hong Kong BN(O) route; or
(d) the applicant falls within HK 15.1(b) and there are serious and compelling reasons to grant the applicant entry clearance or permission to stay with the parent or grandparent who has permission as a BN(O) Status Holder on the Hong Kong BN(O) route.

注意事項

LOTR 可以申請日期到何時

到網上申請VISA正常時，LOTR 申請才會停止，詳情另行公佈。

VISA其間在英國本土出生的子女是那國國籍

因為子女出生時父母其中一方為 British citizen or ‘settled’ in the UK，該子女才會是 British citizen ，因此該子女會跟從父母國籍。

HK 62.1. The applicant must have spent a continuous period of 5 years with permission on a route in these rules under which a person can settle, of which the most recent grant of permission must have been on the Hong Kong BN(O) route.

太空人注意事項

因為子女出生時父母其中一方為 British citizen or ‘settled’ in the UK，該子女才會是 British citizen ，因此該子女會跟從父母國籍。

我諗呢啲時勢如果有其它國籍嘅人都會畀咗嗰個其他國籍畀自己嘅仔女先嘅
或者加多句除非父母是但一方有擁有其他國籍

爆就梗嘅，不過會減咗一大班人等apps正式推出先申請，始終聽日網上申請批咗，要三個月內走，而且又要約VAC，真係麻煩咗。但當然另有班人好有興趣聽日同佢哋個系統操練下同做埋壓力測試嘅

可以境內申請，咁我可唔可以以係呢邊準備齊哂d野照埋肺，係uk落機先申請？

HK 26.2. If the applicant is applying for entry clearance or permission to stay and they do not have permission on the Hong Kong British National (Overseas) route on the date of application, the applicant:

(a) must be the child of a person who is being granted permission on the BN(O) Status Holder route at the same time that the applicant is being granted permission; and
(b) must form part of the same household as the BN(O) Status Holder.

HK 26.3. In HK 26.2. a person will form part of the same household as the BN(O) Status Holder if they normally live with the BN(O) Status Holder.

我有個friend 嘅問題都係關於97後over 18。去到英國1）如果唔同住得唔得；2）兩老settlement 唔到影唔影響BNO Household Member 做settlement 同入BC；3）如果兩老根本唔想走, 咁可唔可以用BNO Household Member 帶個仔or囡入到去英國然後分手返香港而唔影響個97後 over 18 居留英國同入籍BC？

P.S. 以我理解, BNO Household Member 好似係冇同住要求. 亦都冇寫一定要同parents (<18 or Adult Child or Dependent)一齊settlement. Definition 上97後over 18 又唔同dependent child or Adult child. 而且又好似冇咩人提, 18-23 成日被遺忘...
