Checking a BN(O) citizen job applicant’s right to work

BN(O) citizens and their dependants granted Leave Outside the Rules at the border have the right to work in the UK. 

BN(O) citizens can use a stamp in their passport as proof of their right to work – this is confirmed in list B, group 1 of the code of practice on preventing illegal working. The stamp restricts their access to public funds but does not restrict their ability to work.

You won’t have to pay a penalty if you employ someone with this stamp in their passport and you’ve checked this allows them to work in the UK.

BN(O) visa route
Applications for the BN(O) visa open from 31 January 2021. Applicants and their dependants under this route will also have the right to work. See more information about the BN(O) visa.

Further information about BN(O)s’ right to work will be published in 2021.
