可能仲有其他法律依據，有巴打指出：
如根據Vienna Convention on the Law of Treaties, Article 69:
1.A treaty the invalidity of which is established under the present Convention is void. The provisions of a void treaty have no legal force.
2.If acts have nevertheless been performed in reliance on such a treaty:
(a) each party may require any other party to establish as far as possible in their mutual relations the position that would have existed if the acts had not been performed;
簡單而言，如果條約依據公約確定失效的話
所有野係要盡可能回歸條約前原應存在既狀況
雖然實際上難以執行，但真係做的話，香港主權及治權就有好大可操作空間
但呢樣建基於英國做野，或條約被宣告無效
如果係前者的話，有人建立流亡政府 係好大機會得到英國承認；如果係後者，都為香港人創造左有利條件
