諗得咁複雜做乜
1. payment in lieu of notice本身就有employment ordinance 保障
2. 退一步講,就算冇employment ordinance保障,你簽termination agreement,其中一個terms and conditions就係收payment in lieu of notice,已經當作有consideration,佢冇比就視作違約
3. 需要用deed去簽的只限於其中一方無條件給予對方額外權利或免除對方責任(例如waiver),但你收取payment作為解約條件又點會需要用deed?
4. 再退一步講,就算當作termination agreement冇效,等於原本employment contract仍然未解除,仍受到原合同保障

呢個情況個termination 係僱主行使權力,其實我無得揀唔accept,呢個情況都算binding?

同埋最大問題係唔termination agreement 唔binding 的話
佢咪可以揀返summary dismissal
呢個情況佢就可以揀唔俾payment in lieu of notice

所以特別係想知佢有冇得咁轉summary dismissal (我估答案係有,法庭以前爭議呢樣嘢都要用waiver 答)
同埋有無得收返payment in lieu of notice ( 係呢個位唔肯定 )

如果冇 勞工法例會包底雙方各有termination嘅權力
